These Terms & Conditions (“Terms”) govern your use of MyFireplaceDoors.com and your purchase of products or services from My Fireplace Doors LLC, operating MyFireplaceDoors.com (“My Fireplace Doors,” “we,” “us,” or “our”).

Please read these Terms carefully before using the website or placing an order.

By placing an order, creating an account, approving a custom order, checking an acceptance box, submitting information in connection with a purchase, or otherwise affirmatively accepting these Terms, you agree to be bound by them.

These Terms should be read together with our Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy, Warranty Information, applicable product-page terms, and any quotation, specification sheet, or written agreement associated with a particular order.

1. About My Fireplace Doors

My Fireplace Doors provides fireplace doors, screens, accessories, decorative products, replacement products, custom products, educational information, product-selection assistance, and related products and services.

Some products are sold and fulfilled directly by us. Others may be manufactured, supplied, or shipped by independent manufacturers, distributors, fabricators, or fulfillment partners.

Because fireplaces vary substantially in construction, dimensions, age, manufacturer, condition, fuel type, and intended use, not every product is appropriate for every fireplace.

2. Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, specifications, compatibility information, pricing, availability, and warranty information.

Manufacturers may change products, materials, packaging, specifications, or finishes without advance notice to us.

Minor differences may occur between photographs, samples, screen displays, and the product received. Color and finish appearance may vary because of lighting, photography, display settings, materials, manufacturing processes, and normal production variation.

If an exact dimension, finish, specification, clearance, or compatibility requirement is material to your purchase, verify it before ordering.

3. Fireplace Compatibility

Fireplace products must be selected for the fireplace on which they will actually be used.

Compatibility may depend on factors including:

  • Fireplace type
  • Manufacturer and model
  • Opening dimensions
  • Surrounding materials
  • Clearances
  • Ventilation requirements
  • Mounting configuration
  • Existing equipment
  • Fuel type
  • Manufacturer instructions
  • Applicable building, fire, and safety requirements

Information provided by My Fireplace Doors is intended to help customers make informed purchasing decisions. It does not replace manufacturer instructions, applicable codes, or an on-site determination by a qualified professional when one is reasonably necessary.

We may recommend against a product when the information available to us indicates that it may not be appropriate for the customer’s fireplace.

4. Measurements and Customer-Supplied Information

Some products depend on measurements, photographs, model information, specifications, or other information provided by the customer.

The customer is responsible for the accuracy and completeness of information the customer supplies.

Before approving a measurement-dependent order, review all dimensions, fireplace information, finishes, options, model numbers, configurations, and other specifications carefully.

If we provide measurement instructions, diagrams, recommendations, or assistance, that assistance does not transfer responsibility for measurements actually taken or supplied by the customer unless we expressly agree in writing that My Fireplace Doors is performing the measurement.

5. Custom and Made-to-Order Products

Custom, made-to-order, and specially configured products may be manufactured specifically for one customer or fireplace.

Production may not begin until required measurements, photographs, drawings, finishes, configurations, approvals, or other information have been received.

For custom or measurement-dependent products, the written specifications approved by the customer constitute the Approved Order for fabrication.

Depending on the product, an Approved Order may identify:

  • Dimensions
  • Fireplace type or model
  • Frame configuration
  • Door style
  • Glass
  • Mesh
  • Finish
  • Hardware
  • Mounting method
  • Options
  • Other customer-specific specifications

Once an Approved Order has been released to production:

  • Changes may not be possible
  • Changes may result in additional charges
  • Cancellation may no longer be available
  • The product may become non-returnable and non-refundable

A product manufactured correctly to customer-supplied and approved specifications is not defective merely because the customer’s measurements or other supplied information were incorrect.

Our Returns & Refunds Policy governs custom-order cancellations and return eligibility.

6. Custom-Order Acknowledgment

Custom, made-to-order, special-order, and other non-returnable products may require affirmative acknowledgment of their applicable cancellation and return restrictions before the order is released to production.

We may retain the date, time, specifications, approval record, and electronic acknowledgment associated with that approval.

A customer’s approval of an order authorizes us and our applicable manufacturer, distributor, or fabricator to proceed according to the approved specifications.

7. Orders and Acceptance

Submitting an order does not necessarily mean the order has been finally accepted.

We may review orders for:

  • Product availability
  • Pricing accuracy
  • Shipping feasibility
  • Compatibility concerns
  • Missing information
  • Payment authorization
  • Suspected fraud
  • Manufacturer availability
  • Other legitimate fulfillment concerns

An automated order acknowledgement confirms receipt of the order. It does not necessarily constitute final acceptance.

Where permitted by law, we may decline or cancel an order before fulfillment if:

  • The product is unavailable
  • Required information is missing
  • A material pricing or catalog error occurred
  • Shipping cannot reasonably be completed
  • Fraud or unauthorized payment is suspected
  • A manufacturer or distributor cannot fulfill the order
  • The order cannot reasonably be completed as represented

If we cancel an order after collecting payment, amounts paid for the cancelled portion will be refunded.

8. Pricing and Payment

Prices are stated in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping charges, freight charges, special handling charges, and other disclosed charges may be added to the order.

We make reasonable efforts to maintain accurate pricing. If a material pricing error is discovered before fulfillment, we may contact the customer with the correct price or cancel and refund the affected portion of the order as permitted by law.

Payment must be successfully authorized before an order is processed unless separate written payment terms have been agreed upon.

9. Shipping and Delivery

Processing times, production estimates, freight procedures, delivery requirements, damage reporting, risk of loss, shipping charges, and other delivery matters are governed by our Shipping & Delivery Policy, which is incorporated into these Terms.

Production and delivery dates are estimates unless a particular date is expressly guaranteed in writing.

Customers should receive and inspect the complete product before scheduling an installer, contractor, or other work dependent upon the shipment whenever reasonably possible.

10. Returns, Refunds, and Cancellations

Returns, refunds, cancellations, restocking charges, refused shipments, return authorizations, custom-product restrictions, and related matters are governed by our Returns & Refunds Policy, which is incorporated into these Terms.

Custom, made-to-order, measurement-dependent, special-order, installed, modified, used, and final-sale products may be subject to restrictions different from ordinary stocked merchandise.

Review the applicable return conditions before purchasing.

11. Inspection Before Installation

Inspect products before installation.

Confirm that:

  • The product received matches the order
  • Dimensions are correct
  • Required components are present
  • Glass and other fragile components appear undamaged
  • The finish and configuration are correct
  • The product appears appropriate for the intended fireplace

Do not install, drill, cut, paint, burn, permanently mount, or otherwise modify a product you believe is damaged or incorrect before contacting us.

Installation or modification may affect return, freight-claim, or warranty eligibility.

12. Installation

Products must be installed and used according to applicable manufacturer instructions and safety requirements.

Some products may reasonably be installed by a homeowner. Others should be installed by a qualified professional.

The fact that a product can physically be attached to a fireplace does not necessarily establish that the installation is appropriate, code-compliant, or safe.

Unless installation is expressly included in a written order or service agreement with My Fireplace Doors, the purchase of a product does not include installation.

13. Independent Installers and Service Providers

My Fireplace Doors may identify, refer, coordinate with, or provide information about independent installers, tradespeople, manufacturers, or other service providers.

Unless expressly stated otherwise in a written agreement, an independent provider is not our employee, agent, partner, or joint venturer and controls the manner in which that provider performs its work.

An agreement entered directly between a customer and an independent provider is between those parties.

If installation or another service is purchased directly from My Fireplace Doors under a written scope of work, that written agreement controls the service.

14. Manufacturer Warranties

Some products are covered by written warranties issued by their manufacturers.

Unless My Fireplace Doors expressly issues a separate written warranty for a particular product, a manufacturer’s warranty remains the obligation of the manufacturer under its own terms.

Warranty duration, coverage, exclusions, procedures, and remedies are determined by the applicable written warranty.

Where a written manufacturer warranty applies and is supplied to us, we will make the applicable warranty information available before purchase through the product page, linked warranty documentation, order information, or another appropriate pre-purchase method.

Our Warranty Information page explains how warranty requests are handled.

Nothing in these Terms eliminates warranty or consumer rights that cannot lawfully be waived.

15. Implied Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY FIREPLACE DOORS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE EXCEPT TO THE EXTENT THOSE WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

IF MY FIREPLACE DOORS ISSUES A WRITTEN WARRANTY OR OTHERWISE ENTERS INTO A TRANSACTION FOR WHICH APPLICABLE LAW PROHIBITS DISCLAIMER OF AN IMPLIED WARRANTY, ANY IMPLIED WARRANTY THAT MAY LAWFULLY BE LIMITED IN DURATION IS LIMITED TO THE DURATION OF THE APPLICABLE WRITTEN WARRANTY OR THE SHORTEST PERIOD PERMITTED BY LAW.

In plain language: where the law allows it, any implied warranty that applies is limited to the same duration as the applicable written warranty.

This section does not alter or eliminate a manufacturer’s express written warranty and does not waive any consumer right that applicable federal or state law prohibits us from waiving.

16. Accounts

Some website features may allow customers to create accounts or save information concerning one or more fireplaces.

Customers are responsible for:

  • Maintaining the confidentiality of account credentials
  • Providing accurate account information
  • Activity conducted through their accounts
  • Notifying us of suspected unauthorized access

We may suspend or terminate accounts used fraudulently, unlawfully, abusively, or in material violation of these Terms.

17. Fireplace Photographs and Other Submitted Content

Customers may provide photographs, measurements, drawings, reviews, questions, specifications, and other information.

Customers retain ownership rights they have in content they submit.

By submitting content necessary for us to provide a product or service, the customer grants My Fireplace Doors a non-exclusive license to use, reproduce, analyze, store, transmit, and disclose that content to the extent reasonably necessary to:

  • Identify or evaluate a fireplace
  • Recommend products
  • Prepare quotations
  • Manufacture or fulfill an order
  • Communicate with manufacturers or service providers
  • Provide customer service
  • Maintain the customer’s fireplace and order records

Submission of a fireplace photograph for product-selection or fulfillment purposes does not, by itself, authorize us to publish that photograph in advertising, social media, galleries, or other public promotional materials.

Public promotional use requires separate permission unless the content was specifically submitted for public display, such as a published review containing an image.

Customers may not submit content they do not have the right to provide.

18. Website Content and Intellectual Property

The website and its original text, graphics, photographs, diagrams, branding, page designs, educational materials, product-selection materials, and other original content are protected by applicable intellectual-property laws.

Customers may use the website for legitimate personal and commercial purchasing purposes.

Without authorization, users may not:

  • Republish substantial portions of our original content
  • Copy original educational or product-selection materials for use by another business
  • Scrape the website in a manner that interferes with its operation
  • Misuse our trademarks or branding
  • Attempt unauthorized access to website systems
  • Introduce malicious code
  • Use the website for fraud or unlawful conduct

Manufacturer trademarks, photographs, product information, and other manufacturer-owned materials remain the property of their respective owners where applicable.

19. Reviews and Public Submissions

If you submit a product review, testimonial, photograph, or other content specifically intended for public display, you grant My Fireplace Doors a non-exclusive, royalty-free license to display, reproduce, format, and distribute that content in connection with the website and our business.

We may moderate content that is unlawful, fraudulent, threatening, obscene, unrelated, contains private information, infringes another person’s rights, or otherwise violates these Terms.

We will not condition publication of a legitimate customer review solely on whether the review is favorable.

20. Product Use and Safety

Fireplaces involve fire, heat, glass, combustible materials, fuel, ventilation, and other conditions capable of causing property damage, personal injury, or death when products are improperly selected, installed, maintained, or used.

Customers must follow:

  • Product instructions
  • Fireplace-manufacturer requirements
  • Applicable warnings
  • Fuel requirements
  • Clearance requirements
  • Appropriate maintenance procedures
  • Applicable building and fire-safety requirements

Nothing on MyFireplaceDoors.com authorizes use of a product in a manner prohibited by its manufacturer or applicable law.

21. California Proposition 65

Some products sold or shipped into California may require a warning under California Proposition 65 based on the materials, components, chemicals, or exposures associated with the particular product.

Where a product-specific Proposition 65 warning is required and the applicable information is provided to us, the warning will be presented in the manner required for that product, which may include the product page, packaging, documentation, or another required pre-purchase location.

Customers purchasing products for use in California should review any product-specific warning provided before purchase and use.

A general statement in these Terms is not intended to substitute for a product-specific warning where one is legally required.

22. Website Information

We make reasonable efforts to provide useful and accurate educational and product information.

Articles, diagrams, measurement instructions, identification guidance, product recommendations, photographs, and other website materials are provided for general information and purchasing assistance.

They do not replace an on-site professional determination when the particular condition, construction, or configuration of a fireplace reasonably requires one.

23. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY FIREPLACE DOORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF USE, PROJECT DELAYS, CONTRACTOR CHARGES, OR SIMILAR CONSEQUENTIAL LOSSES ARISING FROM OR RELATING TO A PRODUCT, ORDER, SERVICE, WEBSITE USE, OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MY FIREPLACE DOORS ARISING FROM OR RELATING TO A PARTICULAR PRODUCT, ORDER, OR SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO MY FIREPLACE DOORS FOR THE PRODUCT, ORDER, OR SERVICE GIVING RISE TO THE CLAIM.

These limitations do not apply to the extent prohibited by law and do not limit liability that cannot legally be limited, including liability where applicable law prohibits limitation because of the nature of the conduct or injury involved.

They also do not eliminate remedies expressly provided by an applicable written warranty or non-waivable consumer protection law.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent legally permitted.

24. Customer Responsibility and Third-Party Claims

To the extent permitted by law, a customer is responsible for losses or third-party claims to the extent caused by the customer’s:

  • Intentional misuse of a product
  • Installation contrary to applicable manufacturer instructions
  • Unauthorized modification of a product
  • Use of a product for an application the customer knew or reasonably should have known was improper
  • Violation of applicable law
  • Fraud or material misrepresentation

To the extent permitted by law, the customer agrees to indemnify and hold harmless My Fireplace Doors from third-party claims, damages, and reasonable costs to the extent directly caused by such conduct.

This obligation does not require the customer to indemnify My Fireplace Doors for losses caused by our own negligence, wrongful conduct, defective performance, or another matter for which applicable law makes us responsible.

25. Circumstances Beyond Reasonable Control

We are not responsible for delays in performance caused by circumstances reasonably outside our control, including:

  • Severe weather
  • Natural disasters
  • Transportation interruptions
  • Carrier disruptions
  • Labor disruptions
  • Material shortages
  • Manufacturer interruptions
  • Utility or communications failures
  • Government actions
  • Emergencies

This section does not eliminate cancellation, refund, shipment, or other rights applicable law requires us to provide.

26. Payment Disputes

If you believe a transaction, delivery, refund, or product has been handled incorrectly, contact us before initiating a payment dispute whenever reasonably possible.

We will make a reasonable effort to investigate and resolve legitimate problems.

A chargeback or payment dispute does not by itself:

  • Cancel an order
  • Alter an Approved Order
  • Make a custom product returnable
  • Create a refund right that did not otherwise exist

When responding to a payment dispute, we may provide relevant transaction records to the payment processor or financial institution, including order records, tracking, delivery confirmation, customer communications, approval records, specifications, acknowledgments, and photographs.

Nothing in this section restricts a customer’s lawful right to dispute an unauthorized or legitimately contested transaction.

27. Time Limit for Claims

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM ARISING FROM OR RELATING TO A SALE OF GOODS, THESE TERMS, OR A TRANSACTION WITH MY FIREPLACE DOORS MUST BE COMMENCED WITHIN ONE YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES.

A claim not commenced within that period is barred to the extent applicable law permits the parties to shorten the otherwise applicable limitations period.

This provision does not shorten a limitations period where applicable law prohibits contractual shortening, and it does not alter special accrual rules that cannot lawfully be modified.

28. Governing Law

These Terms and transactions with My Fireplace Doors are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles, together with applicable federal law.

This choice of law does not deprive a consumer of a protection that applicable law makes non-waivable.

29. Venue and Jurisdiction

Except for an eligible small-claims matter or where applicable law requires otherwise, any legal action arising from or relating to these Terms, the website, or a transaction with My Fireplace Doors must be brought in a state court located in Oklahoma County, Oklahoma, or, when federal jurisdiction exists, the applicable United States federal court serving Oklahoma County.

Each party consents to personal jurisdiction in those courts to the fullest extent permitted by law.

An individual customer may bring an eligible claim in a small-claims court having lawful jurisdiction over the dispute where applicable law permits.

30. Individual Claims and Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MY FIREPLACE DOORS AGREE THAT CLAIMS BETWEEN US WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Neither party waives the right to pursue an individual claim in an appropriate court, including an eligible small-claims matter.

If applicable law does not permit this waiver for a particular claim, the waiver will not apply to that claim, and the remaining provisions of these Terms will remain in effect.

31. No Mandatory Arbitration

These Terms do not require customers to submit disputes to private binding arbitration.

Subject to the governing-law, venue, class-action, and other provisions of these Terms, either party may pursue an available judicial remedy.

32. Electronic Communications and Acceptance

By conducting business with us electronically, you consent to receive routine transaction-related communications electronically, including:

  • Order confirmations
  • Receipts
  • Shipping notices
  • Custom-order specifications
  • Approval requests
  • Return information
  • Warranty communications
  • Account notices
  • Other records relating to your transaction

Electronic acceptance, including a checkbox, button, electronic signature, written email approval, or comparable affirmative action, may constitute your agreement to applicable order terms.

We may retain electronic records of those actions.

Nothing in this section substitutes for any separate form of electronic consent or disclosure that applicable law specifically requires.

33. Website Accessibility

My Fireplace Doors seeks to make its website and purchasing information reasonably accessible to customers with disabilities.

If you experience difficulty accessing information, using a website feature, or completing a purchase because of an accessibility issue, contact us.

We will make reasonable efforts to provide the requested information or assistance through an appropriate alternative method.

Accessibility concerns may be reported through our Contact page, by email, telephone, or mail.

34. Third-Party Websites and Services

MyFireplaceDoors.com may link to websites or services operated by manufacturers, payment providers, carriers, installers, and other third parties.

Those services are controlled by their respective operators.

A link or reference does not mean that we control or accept responsibility for an independent third party’s website, content, privacy practices, or services.

35. Website Availability

We work to keep MyFireplaceDoors.com accurate and available, but uninterrupted operation cannot be guaranteed.

The website may occasionally be unavailable because of maintenance, technical failures, hosting interruptions, security events, third-party services, or other circumstances.

We may modify, replace, or discontinue website features as the business develops, subject to obligations associated with existing orders and applicable law.

36. Changes to These Terms

We may update these Terms as our business, products, website, services, or legal obligations change.

The Last Updated date at the top identifies the current version.

Changes apply prospectively unless applicable law requires otherwise.

We will not retroactively modify the terms governing an existing transaction merely to deprive a customer of rights applicable when the transaction was made.

37. Assignment

Customers may not assign contractual rights or obligations arising from an order without our written consent when the assignment would materially affect our obligations or rights.

My Fireplace Doors may assign these Terms or an order in connection with a merger, acquisition, financing, reorganization, sale of substantially all relevant assets, or similar business transaction.

No assignment will eliminate customer rights that cannot lawfully be transferred or waived.

38. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted when possible, and the remaining provisions will remain in effect.

39. Waiver

Failure by either party to enforce a provision on one occasion does not automatically waive the right to enforce that provision or another provision later.

A waiver must be clear and applies only to the matter for which it is given.

40. Survival

Provisions that by their nature should continue after completion, cancellation, or termination of a transaction will survive, including provisions concerning:

  • Payment obligations
  • Intellectual property
  • Submitted-content rights
  • Warranty limitations
  • Limitation of liability
  • Third-party claims and indemnification
  • Dispute procedures
  • Governing law
  • Venue
  • Claim limitations
  • Records relating to completed transactions

41. Entire Agreement

For purchases through MyFireplaceDoors.com, these Terms, applicable product information, the Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy, Warranty Information, and any applicable Approved Order, quotation, specification sheet, or separately executed written agreement together constitute the agreement governing the transaction.

If a separately signed written agreement directly conflicts with these Terms concerning a particular custom project or service, the separately signed agreement controls that matter.
